1. Service Description

CookieGuard ("the Service") is a web-based platform that provides website cookie scanning, compliance analysis reports, and customizable cookie consent banners. The Service helps website owners identify cookies, trackers, and potential privacy regulation violations on their websites.

2. Account Registration

To access certain features, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

3. Plans and Billing

CookieGuard offers free and paid subscription plans. Paid plans are billed monthly or annually via Stripe. Prices are listed on our pricing page and may change with 30 days' notice. Refunds are available within 14 days of initial purchase if you are unsatisfied with the Service.

Free plan users receive limited scans per month. Paid features include increased scan limits, cookie auto-blocking, consent banners, API access, and priority support as described on the pricing page.

4. Acceptable Use

You agree to use CookieGuard only for lawful purposes. Specifically:

• You may scan websites that you own or have explicit authorization to scan.
• Public scans (unauthenticated, single-page scans) may be performed on any publicly accessible website.
• You must not use the Service to conduct unauthorized security testing, vulnerability scanning, or any form of attack on third-party websites.
• You must not attempt to reverse-engineer, decompile, or extract the source code of the Service.
• You must not resell scan results or reports without a valid agency or enterprise subscription.

5. Scan Accuracy Disclaimer

CookieGuard provides scan results on a best-effort basis. While we strive for accuracy, our scans may not detect every cookie, tracker, or compliance issue on your website. Scan results do not constitute legal advice. We strongly recommend consulting with a qualified legal professional for definitive compliance guidance. CookieGuard is not liable for any regulatory fines, penalties, or damages arising from reliance on our scan results.

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, software, and the underlying technology — are the exclusive property of CookieGuard and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of your website content and scan data.

7. Limitation of Liability

To the maximum extent permitted by applicable law, CookieGuard and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid to CookieGuard in the twelve (12) months preceding the claim.

8. Termination

You may terminate your account at any time by contacting us or using the account settings. We may suspend or terminate your access if you violate these Terms or engage in activity that harms the Service or other users. Upon termination, your data will be deleted in accordance with our Privacy Policy.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Tel Aviv, Israel.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or a prominent notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
